Why is she trying to sue? There's no laws prohibiting taking video without consent. The Constitution doesn't explicitly give anyone the right to privacy. Most people think that it does, but it doesn't. There are some aspects of privacy that are implied in the Third and Fourth amendments of the Constitution. But these amendments only protect people from having soldiers quartered in your home or protecting against illegal searches and seizures without a warrant or "probable cause". None of this applies to videotaping someone without consent. The only other laws that *could* prohibit it (but really don't) are state laws. Depending on where the video was shot (and we don't even officially know that), there could be more detailed laws on videoing without consent. Usually, without audio it is perfectly fine, even when its taken with a hidden camera. Most courts in the US have deemed this legal. In most states, if you want to record audio, you need to have the consent of 1 of the parties being audiotaped. In a few, you need all. There's not really any audio in the Erin Andrews video except what you can hear playing on a TV in either her room or an adjacent room. Andrews isn't talking so there's no conversation to be heard. As far as recording just video is concerned, it is legal in almost all states unless the camera is in a bathroom or locker room. Andrews is presumably being taped in a hotel room (and not in a bathroom or locker room). It could further be argued that since she is not in her home, she is in a public location. Her lawyer is trying to make it seem like she has some kind of legal recourse... I really don't see how she does. Can someone please explain why she is trying to pursue charges? | Blame Roe V. Wade, it established the Constitution contains a "right to privacy" that has come in to play many times since. Anyway to add to that a Hotel Room is STILL factored in with the idea of being in your own home/Apt. You PAID for the room. You have the right to privacy in the room. So what about an Apt? | What do I do with my problem 6 year old? My son is 6 and in grade 1. He was being bullied earlier this year and we went and dealt with it and are still dealing with it. He acted agressive toward me until we found out he was being bullied. Then the aggression stopped but now he has taken to locking himself in his locker at school, hiding from various teachers and just not listening...I am at the end of my rope and have no more solutions...we tried removing everything that could be considered remotely fun from his room, stopped all video games and movies, t.v watching etc...nothing worked...123 magic, not a chance...grounding to his room...nope...HELP |
| Well, it sounds like you have been a very busy mom lately! I am big on reasoning with guys. Basically asking them the reason for their behavior (there is often something else that is bothering them, hence the bullying) also I think its important for them to know how what they do makes others feel ( I am not above saying something like " Don't you know when you act like this you make mom/dad/your teacher feel bad?" then explaining there are consequences for bad behavior.
